VICTORY! Agreeing with CFC Concerns, SCOTUS Blocks Biden Vaccine Mandate
Sacramento, CA – With a 6-3 decision earlier today, Supreme Court justices blocked the Biden Administration’s COVID-19 vaccination mandate. California Family Council joined 30 other state-based family policy organizations in an amicus brief opposing the policy.
“Thankfully, the US Supreme Court recognized the dangers of President Biden’s unconstitutional overreach and declared his administration’s ‘no jab, no job’ policy illegal,” said Jonathan Keller, president of California Family Council. “The federal government must respect the freedom of employers and employees to make the best medical decisions for themselves and their families.”
The stay prohibits the Emergency Temporary Standard (ETS) of the Occupational Safety and Health Administration (OSHA) mandate. In reviewing the case, the Court recognized the dangers of executive branch overreach, reminding federal officials of the clear congressional authority enshrined in the Constitution.
“Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly,” the six justices noted. “Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category.”
In a separate but connected case, the justices voted 5-4 to uphold a vaccine mandate applying to healthcare workers at federally funded facilities. However, this mandate includes a religious exemption.
